The Workplace (Health, Safety and Welfare) Regulations 1992 do not make specific recommendations on the temperature of water used in washing facilities. The accompanying ACoP states that washing stations should have running hot and cold or warm water. Any showering facilities that are fed by both hot and cold water should be fitted with a device such as a thermostatic mixer valve to prevent users being scalded. The HSE has published guidance on water temperatures in care homes. When water temperatures are in excess of 44C, there is a high risk of burns or scalds to the elderly and other vulnerable people, including children. Anyone with reduced sensitivity to temperature or anyone who cannot react appropriately, or quickly enough to prevent injury will be at risk. The former Department of Health has also published guidance that recommends how to meet employers’ legal duty of care in respect of the risk of scalding and burning from hot water.
