If you are employed 6 months and above, you are automatically considered regular employee and are entitled for back pay. If you are terminated with due process because of absences, it is legal so long as done with due process. Due process means, the employer has to issue you a memorandum for you to explain in 24 hours or in 2 days, etc. which you have to comply otherwise, you will be considered not interested and AWOL or absence without Leave.
