Is the terminated due to absences, probationary employee entitled to back pay in the philippines?
If you are employed 6 months and above, you are automatically considered regular employee and are entitled for back pay. If you are terminated with due process because of absences, it is legal so long as done with due process. Due process means, the employer has to issue you a memorandum for you to explain in 24 hours or in 2 days, etc. which you have to comply otherwise, you will be considered not interested and AWOL or absence without Leave. Please log on to www.dolecar,net if you are in Region one and region two. Or otherwise, try to locate your DOLE or Dep’t of Labor and Employment Office in you area and ask for help.
