Is the protection given by the registration indefinite?
The protection given is indefinite in the sense that the registration can be renewed any number of times. When a trademark is registered the initial term of protection is generally 10 years. Upon the expiry of this period the owner has to pay a renewal fee for each subsequent renewal period, which is also 10 years in many countries. It may be noted, however that in some countries if a mark is not used by the owner in that country for a certain period of time – generally 3-5 years, any person intending to use the mark can get the mark cancelled. In such situation the protection will cease once the registration is lost for non-use.
