Is the mediation agreement legally binding?
The Memorandum of Understanding is a thorough and detailed agreement about all the issues that have been resolved. However, it is not legally binding. Only lawyers or the court can develop a legally binding agreement. Once you receive the Memorandum of Understanding from the mediator, each of you should seek independent legal advice about the agreement and have the Memorandum of Understanding incorporated into a legally binding agreement.
