Is the martial law declared in maguindanao constitutional?

IS THE DECLARATION OF MARTIAL LAW in Maguindanao constitutional? For me it is NOT constitutional to declared martial law in a region in Mindanao. On what ground is it justifiable? Who will declare this the President of the Republic of the Philippines? Because she is the only person who can declare and abolish the imposition of martial law just like what the late dictator President Marcos did in 1972 when he declared the entire Philippines under martial law. IN ACTUAL FORM, this is debatable. And only the supreme court can decide if ever the imposition of martial law is constitutional or not in Maguindanao. To me it is UNCONSTITUTIONAL by nature. Even at the time of President Marcos of imposing the martial law then was considered to be unconstitutional but nobody contested that issue. But this time it is a different one, lots of people will contest the declaration of martial law in Maguindanao, I bet even some senators will say it is unconstitutional, moot and academic.
