The restriction of awards in medical malpractice should not be implemented until the medical profession begins effectively to police itself and weed out incompetent doctors. We have all heard of doctors who make a mistake but are not fired. They are just moved along to another hospital to make more mistakes there. (Sort of like the pedophile priests going from church to church). Doctors need to assume a higher risk for their higher rewards. Maybe we should take a close look at the medical malpractice insurers to see if their rates are too high in light of the risks they assume. Also, judges have authority to reduce jury awards if the judge feels the award if excessive.
