The above is fundamentally accurate but the tenant is not automatically free of any obligation. If the tenant is renting a home as opposed to an apartment he may have some responsibility for reasonable upkeep and maintenance. If he fails to water the tree for a year and that is the cause of the tree falling, the owner may have recourse against the tenant.
