There is not yet a requirement to participate; the legislation is built around financial incentives to encourage EHR implementation and penalities for late adoption. For at least the next 10 years-the period covered by the legislation-participation is voluntary. Section 3006(a)(1) of the HITECH Act says: “nothing in such Act or in the amendments made by such Act shall be construed to require a private entity to adopt or comply with a standard or implementation specification adopted under section 3004.
