Is the consumers “authorization” required to re-present the NSF check and electronically charge (debit) the consumers account?
No. The consumer’s “authorization” is not required for Electronic Check Recovery. However, the business is required to have provided notice to the check writer, prior to receiving the consumer’s check, informing them of NSF Express’s Recovery policy under which the consumer’s check may be collected electronically if it is returned for (NSF) non-sufficient funds or uncollected funds.
