Is the Change to BC-STV Open to Legal Challenge?
All voting systems are open to legal challenge. Currently, the “first past the post” system is under a Charter challenge conducted by the Constitutional Test Case Centre, Faculty of Law, University of Toronto. It is difficult to imagine that a court would toss out a decision popularly endorsed by a double 60% majority, particularly when the proposed system is more democratic than the one it replaces.
