Is the Arbitrators ruling binding?
The parties can agree, either through a previously agreed contract provision or by separate agreement, to make the arbitration binding or non-binding. If binding, the ruling or award of the arbitrator usually usually concludes the dispute. If non-binding, one or more parties may elect to take the action to court if they are not satisfied with the outcome. Even non-binding arbitration often leads the parties to resolve their dispute by way of settlement.
