No. This license constitutes GPL V2.X and the upgrade should be GPL V3. It should be upwards compatible with GPL V3 and later, not backward compatible to GPL V2. It “should” be, provided that GPL V3 has a provision which protects software that is run over networks and has a download source facility built in.
