Is the adversarial system fair and justice?

0

Not always. In principle, the adversarial system is configured of opposing advocates mediated by an impartial judge with a jury trying to determine the truth. Since the system is composed of people and people are fallible, it is impossible to design a totally fair and just system. Advocates of the system would say that it is more fair and less prone to abuse than any other system whereas opponents would say that it is less fair and more prone to abuse due to plea bargaining and settlements. Having said that, no Country is said to have come up with a better system.
