ATO Position Registration is mandatory where an entity’s annual turnover of taxable supplies and GST-free supplies exceeds $50 000 (ss. 23-5, 23-15 A New Tax System (Goods and Services Tax) Act 1999 (‘the GST Act’)). The making of input taxed supplies does not contribute to this $50 000 threshold. If levies are for the payment of taxable supplies, it does not matter if the recipient is registered or not. The supply made by the Body Corporate/Owners’ Corporation is a right as they have entered into an obligation to take care of the complex. This is a taxable supply. If the total levies the Body Corporate/Owners’ Corporation is entitled to receives for any 12 month period exceeds $50 000, registration is mandatory. Otherwise, registration is optional.
