The law makes a limited set of qualified relatives eligible to apply for coverage under the FLTCIP, but it does allow OPM some discretionary authority to designate other groups as qualified relatives. OPM has designated same-sex domestic partners of employees or annuitants, other than of active or retired members of the uniformed services, as qualified relatives eligible to apply for coverage under the FLTCIP. Such individuals must have submitted (either directly or through the partner) a form affirming their status as same-sex domestic partners to the partners agency or retirement system.
