Is novelty eyewear subject to the impact testing regulations?
A. FDA strongly recommends that you conduct impact testing of any glass or plastic lenses used in novelty eyewear to help ensure the safe design of these products. In general, FDA does not require impact testing of novelty eyewear if: • the item is a novelty item, which is not intended to provide children (or other users) with corrective power or protection from bright sunlight; and • a warning label stating that the item is not to be worn outside as sunglasses to protect the eyes against strong sunlight is placed on eyewear that has dark-colored lenses. However, all novelty eyewear may be subject to regulation by the Consumer Product Safety Commission (CPSC) under the provisions of the Federal Hazardous Substances Act (FHSA)1 .
