Is medicinal Cannabis legal under California State law?
Yes. Under California State law, qualified patients with a written recommendation from a licensed physician may cultivate and possess medical cannabis under certain circumstances as established by Proposition 215 (The Compassion Use Act of 1996) SB 420, and Health & Safety Code ยงยง 11362.5, 11362.7 et seq. Please note: Medical Cannabis is illegal under Federal law. However, it is the policy of the Obama Administration not to prosecute Medical Cannabis Collectives and qualified patients that are compliant with state law.
