IS MEDIATION CONFIDENTIAL?

0

Kentucky’s Model Mediation Rules provide for mediation sessions to be completely confidential except in situations where a mediator, like any adult, has a statutory duty to report allegations of neglect and/or abuse.

Mediation is confidential. Confidentiality allows participants to speak openly and with candor, without fear that what they say will later be used against them.

Mediation is a private, confidential process, not open to public scrutiny. You will be asked to sign a confidentiality agreement before beginning the mediation process. All parties, including the Mediator, are required to keep confidentiality about the issues discussed in the mediation process.
