Is marital status an issue when it comes to seeking child custody?
Normally there is no difference. In our times, many parties are choosing not to be married. The difference is how the parties have interacted with the child. If the child has resided with the parents, there really is no difference in how a custody and visitation issues are handled in this type of arrangement. However, where the parties have not been married and living apart , the court will take a closer look, depending how the non custodial parent has been involved, interacted with the child, the more they have bonded , the higher amount of custodial time is given. But normally, married or not, custody and visitation issues are pretty much the same.
