Loitering is usually a local law, and there is no universal or national law concerning loitering. In general it is not unlawful. In fact, I am loitering about my house right now. In addition, the u.s. Supreme Court has put serious limitations on the ability of a state or local government to prohibit hanging out with no apparent purpose. So, the way in which it arises now is that a private property owner, like a store, prohibits hanging about and then when people refuse to leave they become trespassers.
