Yes. Experienced DuPage DUI lawyers can often successfully negotiate a rescission to the statutory summary suspension. Positive negotiations are most often accomplished when the DUI has been charged under a local ordinance and the prosecutor is the local prosecutor for the village or city where the DUI took place. If you have been charged under the State Statute for DUI the prosecutor will be the DuPage County State’s Attorney’s Office. In these cases, a negotiated rescission of the statutory summary suspension is much less likely. Every case is different and whether or not the prosecutor will be willing to negotiate is always based on a case by case basis. Moreover, as in any negotiation you will almost always give something up in order to get what you most want.
