If your tenant is still within the dates of their lease, you cannot kick them out unilaterally. If their lease is over and they are now month-to-month tenants, just follow the lease/state’s requirements for notice. Month-to-month tenants do not require a reason to receive notice to vacate, provided you give them proper notice (ie 30 or 60 days). If your tenant is not month-to-month, you may want to just talk to them to work out a deal. They may be willing to move for a free month of rent and the full refund of their security deposit, regardless of damages. Who knows; maybe they’re looking for a reason to leave, anyway. Just talk to them and work something out; you cannot force them to leave, but you can certainly make it worth their while.
