you should check with an attorney, but it is my understanding, if someone calls you, you can record without telling them, but you cannot call someone, and record them without telling them.

Is is not illegal to record them, but that evidence will not be admissible in court. In order for the tape to be used as evidence, the person will have to have known that they were being recorded.
