No, you can buy them online. The problem is that you are supposed to declare out-of-state purchases in your state taxes, and pay the state sales tax and other taxes on them. For example, here in Michigan, if I were to order cigarettes online from another state, I would be expected to declare those purchases, and pay a 6% sales tax on the cost, as well as the state tobacco taxes of $2.00 per pack (and a 6% tax on that as well). Otherwise, that would be considered tax fraud or tax evasion, and I would be subject to fines and possibly criminal charges.
