Is it better to inherit assets outright or in trust?
It is almost always preferable to inherit assets in trust. Properly drafted trusts offer significant asset protection from creditors. Creditors include the typical tort creditors, as well as spouses in the event of divorce. Trusts may be drafted to give the child/beneficiary significant control over the assets, the investments, and ultimate asset distribution, while protecting the asstes from lawsuits and divorcing spouses.
