I would file separately. Just to be on the safe side. Lords knows if he owes back taxes. Sounds like your ex has something to hide if he’s always penalized all the time. This way he can’t take a credit on you.

We filed jointly because of the added value and we can still talk, I hate her but we need the money. If there is enough trust left and joint is a better option do it. as long as you are still legally married you wont get into any trouble.
