Is implementation of the actions in the Strategy mandatory or voluntary?
For the most part, implementation of the Strategy is happening in voluntary partnership with ports and other key stakeholders. In some cases there are regulatory drivers, e.g., if a port is in a non-attainment area for ozone and/or particulate matter, or if the port has to have a permit for stormwater runoff. Since a number of the action items listed are not mandated by Congress or tied to Federal regulations, their success will hinge on the voluntary commitment and participation of port authorities, private marine terminal operators, and other entities within the marine transportation system.
