Is E.R.S. Canada responsible for any consequential damages related to a service call?
No. E.R.S. Canada will not be liable, under any circumstances, for any indirect, special, incidental or consequential damages of any kind (including lost profits) regardless of the form of action whether in contract, tort (including negligence), or otherwise, even if E.R.S. Canada has been advised of the possibility of such damages. In no event shall E.R.S. Canada’s maximum aggregate liability exceed the total amount paid by you for the services.
