Ms. Arden clarified that CMS enters discussions with States when a State poses questions about self-direction policy and programming. She stated that CMS has a statutory requirement that requires program safeguards for health and safety. In any program there are numerous individuals with a wide range of abilities. She explained that it is important to protect those people who are at higher risk. All aspects of these programs need to be analyzed. HOW ARE FINANCIAL ARRANGEMENTS ESTABLISHED TO PROTECT FROM RISK? IS THERE A FAILSAFE SYSTEM? CMS assesses State programs to make sure they are following IRS rules when contracting Personal Assistance Services (PAS). If not there is a high risk.
