No. A pilot was introduced by way of Practice Direction for civil cases in Toronto only. Under this pilot, cases will no longer be automatically assigned to case management under Rule 77 but will have access to the less structured case management options set out under Rule 78. Targeted case management will be made available for cases that require management to the degree required by the circumstances of the case. In addition, Rule 77 remains available for specific circumstances or where there has been chronic and substantial delay. Case management under Rule 77 in both Ottawa and Windsor is working well. The pilot will not affect the operation of Rule 77 in these locations. Rule 78, which was introduced on May 6, 2005 but applies to cases commenced since the beginning of 2005, implements the key elements of the Practice Direction.
