Is Ash Scattering legal?
Yes. Texas Health and Safety Code 716.304 of the Texas law allows for the release of scattered ashes. The FAA allows the release “if reasonable precautions are taken to avoid injury or damage to persons or property.” If it is desired to scatter the ashes over private property, the property owner must give permission to release the ashes. Releasing the ashes over a state or national park requires permission and is available but may delay the scattering of ashes.
