Is AOL Time Warner Is Illegally Using Songs From The EMI Library?
EMI Music Publishing contends that AOL Time Warner is illegally using songs from such classic MGM films as “Singin’ in the Rain” and “The Wizard of Oz” for promotional spots and background music on America Online and Turner Broadcasting. EMI Music Publishing chairman Martin Bandier said he has tried to negotiate an amicable licensing deal with AOL TW, but thus far, talks have failed. Bandier said EMI will file a copyright-infringement suit today against AOL TW in the Southern District Court of New York, seeking monetary damages and injunctive relief. An EMI Music Publishing spokesman said damages sought could run into the millions of dollars. An AOL TW spokeswoman declined comment. The conflict stems from a 20-year-old contract between EMI Music Publishing and the companies United Artists Corp. and MGM/United Artists, Bandier said.
