Is anyone familiar with negotiating leases or construction contracts with “Green” provisions included therein?
This was selected as Best Answer Geoff, I’ve seen it done in both leases and construction contracts, with the former being far more difficult than the latter due to (generally) various levels of separation among the interests of the developer, owner, and tenants. In short, it is somewhat difficult to comprehensively ensure that a building is designed green, built green, and operated green. This will normally require agreements among the developer, the AE & construction teams, and the property operator/maintenance group (which may in some cases be hired by the tenants–which would add another level of complication.) To negotiate one portion of this comprehensive approach–such as the lease or construction contract–is much simpler, but still requires an across-the-board agreement on the “green” standard to be achieved and/or maintained.
