A. All public hospitals that have an acute psychiatric unit on campus are proclaimed to be an ‘approved mental health service’ under section 94 of the Act. Where a public hospital is proclaimed as an approved mental health service, any medical practitioner employed by the public hospital (including in the emergency department) who is giving treatment or care to a patient is taken to be employed by the approved mental health service and therefore able to complete an ITO [see sections 12(2) and 12AA(2)].
