What is important is whether the employer can demonstrate that the need is temporary. • Also, although the H2B may only be utilized to bring in foreign workers to perform work that is demonstrated to be temporary in nature, once in the US the workers’ status may be changed, extended and in some cases the employer may obtain permanent work status for the workers.
