No. ADR is often used to resolve disputes that have not reached the point of an actual “case.” In fact, the most effective time to resolve a dispute is often very early because participants have a tendency to become invested in their own view the longer a dispute continues. Positions also have a tendency to harden as parties put their complaints into written form.
