The Arizona Supreme Court has not yet decided a case involving GPS tracking in criminal investigations. However, interpreting the Washington State Constitution, the Washington State Supreme Court has ruled that such use without a warrant constitutes an illegal privacy intrusion. Washington’s Constitution contains the same language used in the Arizona Constitution.
