Is a resolution, a settlement reached in mediation legally binding?
Generally, all mediations end with a written agreement setting forth the obligations, duties and responsibilities of the parties to the settlement agreement. For cases already before a court of law, it is standard practice for the parties to agree that the court will have the authority to enforce the agreement should that be necessary. In cases not before the court, the parties can agree that the agreement may be enforced by a court as it would in any other contract action.
