Is a parent automatically the Guardian of his or her minor child?
No. A parent is considered to be a natural guardian, but if a minor receives an inheritance or a personal injury settlement, the childs parent must be appointed by the court to act as the Guardian of the Estate of the child. Appointment as Guardian of the Estate allows the probate court to oversee the administration of the estate and use of the funds held for the minor.
