Is a Jail Sentence Avoidable in Theft Cases?
The best way to avoid a jail sentence is to find a weakness in the prosecution’s case against you that will result in a dismissal of the charges or a not-guilty verdict at trial. In other cases where the evidence against you is difficult to disprove, it may still be possible to avoid jail time by agreeing to a term of probation and restitution (paying back the victim for the value of the stolen property).
