Under Arizona law (See A.R.S. 41-1604.02), the department is permitted to establish and maintain inmate stores at any of its institutions or facilities. The department is permitted to enter into contracts with a private entity or contractor to establish and maintain the inmate stores. Prices are to be fixed by the contractor with direction from the (DOC) director THAT ARE NO HIGHER THAN PRICES OF SIMILAR RETAIL PRODUCTS, TOILET ARTICLES, CANDY, TOBACCO PRODUCTIONS, NOTIONS AND OTHER SUNDRIES to the persons confined. So, if the usual retail price of a pack of Wrigley’s spearmint gum (10 pack) is $80 – 1.00, the Department cannot sell the same item (10 pack of name-brand chewing gum) for $3.00 each.
