In FP6, is there a right of refusal to grant access rights as in FP5?
In FP5 projects, the principal contractors enjoy access rights to all project results in order to use / exploit these results or in order to exploit the results which they have generated within another FP5 project. A contractor may refuse to grant access rights to another contractor for exploitation purposes if he intends to exploit his results by himself. Such refusal has to be reasoned, and is only considered to be justified if it is economically indispensable in view, in particular, of the market, the risks, and the investment required for the exploitation of the results. FP6 establishes a different access rights system. Access rights to results have to be granted on the written request of a contractor, if he can demonstrate that he needs the results to carry out his own part of the project work, to use them in his further R&D activities or to exploit his own project results.
