The MD must be available to see patients and this documentation must be available to the auditors. While some clinics use the 10% rule for seeing patients this was not the intent of the law which merely states “sufficient periods of time”. Therefore according to a conversation with the federal auditors, they have stated that as long as hours that the MD was available to see patients is posted and in fact his or her signature appeared on at least one chart per visit (every other week) the clinic would be considered in compliance with the rules. 4.
