Lifetime limits on essential benefits are prohibited effective for the first plan year beginning on or after September 23, 2010. Annual limits on essential benefits are permitted, but are restricted. Plan sponsors with plans with annual limits on essential health benefits may request a waiver of these requirements from HHS. For details on the waiver process, view the HHS regulation here.
