The most practical solution is to allow employees on sick leave to designate part of the sick leave as holiday and to take this before the expiry of the current leave year, so that it will not need to be carried over. What do we do if an employee on sick leave does not request annual leave? Employers can serve employees with notice requiring them to take their annual leave. This means that potentially an employer could serve this notice during or in respect of a period of sick leave. What do we do if an employee on sick leave asks to take holiday? An employee may apply to take his statutory holiday whilst on sick leave, and the employer may wish to grant this. That employee should be paid at the rate of pay they would receive if they were working. It may be worthwhile permitting the employee to take only the leave accrued at the time of the application.
