No. The FCC announced that it will no longer permit Broadcast Auxillary Service devices between 698 MHz and 806 MHz as of February 17, 2009 June 12, 2009. See FCC Docket WT 08-188, Notice of Proposed Rulemaking. Additionally, it would be simply be irresponsible to knowingly operate above 698 MHz after February June 2009.
