Yes, if he legally married in India according the Indian matrimonial laws, he has to get the Indian marriage dissolved first,than proceed with marriage in India or any foreign country otherwise he will be committing act of bigamy a punishable offence as well the second marriage of such foreigner will be void in the eye of Indian law & he will be considered married in India.
