If the CPS has missed out some evidence in its request for preparation of a trial file should the police admin team get it anyway to save time later?
A. No. This approach is not proportionate. If the CPS has not asked for certain material it must be assumed that it is not required. This may in the early days give rise to just such a situation that is trying to be avoided, namely a last minute scrabble for overlooked material. However chasing the occasional case is more proportionate than producing unnecessary material in every case. Where this occurs in more than just the occasional case it should be taken up with CPS line management.
