May 26, 2009: The consulting agencies have no decision-making authority under the COGCC rules. However, the CDPHE does have authority to enforce all applicable permits and requirements under its independent jurisdiction, such as surface water discharge permits or air pollution emission permits. The CDPHE and CDOW may also alert COGCC to a concern.
