If the assisted person changes solicitor, can the civil aid certificate for divorce be amended to show the new Solicitor details?
YES, providedthe new solicitor is proceeding under the same grounds as the original solicitor and the record number of the proceedings (if a petition has already issued) has not changed. Alternatively if the new solicitor wishes to proceed on a different ground and providing a petition was not issued by the first solicitor on the original ground, the certificate can be transferred. The above details should be included in any request along with clarification on the usual two points required in transfer cases; -(i)-that there are no material facts which ought to be disclosed to the Legal Services Commission which would affect the transfer of the certificate, (ii)-that there is no reason why, in your opinion, the existing Legal Aid certificate should remain in force.
